Consumers are entitled to a right of cancellation to the following extent, with consumers within the meaning of these T&Cs being any natural persons that conclude a legal transaction for purposes that are mainly attributed neither to their commercial nor their self-employed activity:

A. Cancellation Policy

I. Right of Cancellation

You have the right to cancel this contract within 14 days without specifying a reason.

The notice period for cancellation is 14 days from the day on which you or a third party appointed by you, who is not the carrier, has accepted possession of the most recent goods.

To exercise your right of cancellation, inform us (FLEXI-SPORTS GmbH, Klagenfurter Str. 22, 81669 Munich, Germany, Tel.: +49 (0)89 450 2870, Email: info@flexi-sports.com) about your decision to cancel this contract by way of a clear declaration (e.g. a letter sent by post or an email). To do so, you can use the cancellation form, but this is not required.

To preserve the cancellation period, it is sufficient to send us a notification that you are exercising the right of cancellation before expiry of the cancellation period.

II. Consequences of Cancellation

If you cancel this contract, we must return all payments which we have received from you, including delivery costs (excluding the additional costs arising if you have chosen a different type of delivery than the cheapest standard delivery option we offer) immediately and no later than within fourteen days from the day on which we receive the notification of your cancellation of this contract. For this refund, we will use the same payment method that you used with the original transaction unless otherwise agreed with you; under no circumstances will you be charged a fee for this refund. We may deny a refund until we have received the goods again or until you have provided proof that you have returned the goods, depending on which is the earlier date.

You must send or transfer the goods to us immediately and in any case, no later than within fourteen days from the day on which you inform us that you are cancelling this contract to Supply Studios, FLEXI-SPORTS GmbH, Freisinger Str. 29, 85386 Eching. The notice period is granted if you send the goods before expiry of a period of fourteen days.

We will also assume the costs for returning the goods if you return the goods to us from Germany and use a return note or sticker provided by us, which we will send to you by email or post at your request in the event of cancellation. You can request the returns label or sticker from us by phone using the telephone number above or by email to the above email address. Otherwise, you will bear the direct costs for returning the goods.

For any value loss in the goods, you will only have to meet this if this can be attributed to handling not necessary to check the quality, properties and functioning of the goods.

III. Exclusion or Premature Expiry of the Right of Cancellation

The right of cancellation does not exist for contracts to deliver goods which can quickly spoil or whose expiry date would quickly be exceeded.

The right of cancellation expires prematurely upon delivery of sealed goods which are not suitable for returns for reasons of health protection or hygiene if their seal has been removed after delivery.

 

B. 30-day Return Policy

Regardless of your statutory right of cancellation, we voluntarily grant you as a consumer the following withdrawal commitment:

You can return all items from our shop within 30 days after receiving the goods if the goods are complete and are in an unused and undamaged condition. If the good was delivered in sales packaging, it must still be in the original packaging. The timely sending of the goods is enough to preserve the notice period.

If you choose to avail of this withdrawal commitment, we will reimburse you the purchase price already paid, as well as the dispatch costs. Otherwise, you will bear the direct costs for returning the goods.

This withdrawal commitment does not limit your statutory rights and therefore also not your right of cancellation.
